Information clause

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation "RODO"), we inform you that we process personal data of individuals who:

- have subscribed to the semguru fanpage by clicking the "Like" or "Observe" icon

- have published a comment under any of the posts posted on the fanpage

- Have sent a message via Messenger using the fanpage.

 

  1. PERSONAL DATA CONTROLLER

The administrator of personal data collected using this fanpage is semguru sp. z o.o. with its registered seat in Poznan, 4B/48 Czarnieckiego St. , 61-538 Poznan.

 

  1. DATA PROTECTION OFFICER

We do not have a Data Protection Officer. Any questions about our data processing policies can be directed via a message on our fanpage or by email at: przemek@semguru.pl

 

  1. PURPOSES AND LEGAL BASIS FOR PROCESSING PERSONAL DATA

Personal data of visitors and users of the fanpage will be processed for the following purposes:

- for the purpose of running a fanpage under the name semguru on the social network Facebook, under the terms and conditions set by Facebook Inc,

- for archival (evidential) purposes to secure information in case of a legal need to prove facts, which is our legitimate interest (legal basis - Article 6(1)(f) RODO),

- for the purpose of possible establishment, investigation or defense against claims, which is our legitimate interest (legal basis - Article 6(1)(f) of the DPA),

- for analytical purposes, which is our legitimate interest (basis of Article 6(1)(f) of the DPA),

- for the purpose of surveying customer satisfaction and determining the quality of our products, which is our legitimate interest (legal basis - Article 6(1)(f) of the DPA),

- in order to inform about our activities, to promote various events we organize and our services, as well as to communicate with users through available functionalities - comments, chat, messages (legal basis - legitimate interest consisting in promoting our brand and our services and goods - Article 6(1)(f) RODO).

 

Users' personal data may also be processed on the basis of separately granted consent to the extent and for the purpose specified in the content of the consent and for the time until the consent is withdrawn (legal basis - Article 6(1)(a) RODO), as well as on the basis of statutory requirements (legal basis - Article 6(1)(c) RODO) in order for the Administrator to fulfill its legal obligations under the law.

Provision of personal data is voluntary, but necessary for the purposes mentioned above.

 

  1. CATEGORIES OF PERSONAL DATA PROCESSED

In connection with the operation of the fanpage, we process the following personal data:

- basic identification data (first and last name) to the extent published by users on their own Facebook profiles,

- other data published by users on their own Facebook profiles,

- Anonymized statistical data about the fanpage's visitors available through the "Facebook Insights" function provided by Facebook in accordance with Facebook's non-amendable terms of service, collected through spyware files (called "cookies"), each of which contains a unique user code that can be linked to the connection data of users registered on Facebook, and which is downloaded and processed when the fanpage is opened.

 

  1. RECIPIENTS OF PERSONAL DATA

Users' personal information is shared or may be:

- to public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes that arise from the provisions of generally applicable law (if personal data will be processed to assert claims of other users or entities),

- to other entities that process personal data on behalf of the Administrator on the basis of relevant data processing entrustment agreements signed with the Administrator,

- to the owner of the social network Facebook under the non-amendable data rules set by Facebook available at https://www.facebook.com/about/privacy.

 

Due to the nature of Facebook, information about the people who follow the fanpage, the likes, as well as the content of comments, posts and other information provided by users is public.

 

  1. TRANSFER OF DATA TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS

The Data Controller does not transfer data outside of Poland/EU/European Economic Area subject to the transnational nature of the data flow within Facebook using Facebook's contractual clauses approved by the European Commission and decisions of the European Commission finding an adequate level of data protection for specific countries in accordance with the rules set by Facebook at https://www.facebook.com/about/privacy.

 

  1. DATA RETENTION PERIOD

Users' personal data is stored for the marketing of our products and services until the user objects to its processing for this purpose, revokes consent if the data was processed on the basis of so-called marketing consent, or we ourselves determine that it has become obsolete. Statistical data on fanpage visitors available through the "Facebook Insights" function will be processed for the duration of the availability of such data on Facebook.

 

  1. USERS' RIGHTS

Users have the following rights relating to their personal data:

  1. (a) the right of access to your data and the right to receive a copy of it,
  2. (b) The right to rectify (amend) your data,
  3. (c) the right to erasure,
  4. (d) the right to restrict data processing,
  5. (e) The right to object to data processing,
  6. (f) the right to data portability,
  7. g) The right to lodge a complaint with the supervisory authority - the President of the Office for Personal Data Protection, in the event that the processing of personal data is deemed to be in violation of the provisions of the RODO or other regulations on the processing of personal data,
  8. (h) Right to withdraw to consent to the processing of personal data - at any time users have the right to withdraw their consent to the processing of personal data processed on the basis of previously given consent. Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

 

  1. INFORMATION ABOUT THE SOURCE OF THE DATA

Personal data is obtained through the Facebook social network and from users' public profile, as well as the posts they make on the Facebook fanpage.

 

  1. OTHER INFORMATION

Personal data will not be subject to automated decision-making, including profiling.
